1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the Habibti platform at habibti.chat ("the Service"), operated by Habibti ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use Habibti.

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will notify you of significant changes via email or in-app notice.

2. Eligibility

To use Habibti, you must:

• Be at least 18 years of age.
• Be legally able to enter into a binding agreement.
• Not be prohibited from using the Service under applicable law.
• Not have been previously banned or removed from Habibti.

Habibti is a matchmaking platform designed for Muslims seeking marriage-oriented connections. While we welcome users of all backgrounds who are interested in connecting with Muslim singles, the platform is purpose-built around Islamic values of respectful, marriage-focused interaction.

3. Your Account

You sign in to Habibti using Google OAuth. You are responsible for:

• Maintaining the security of your Google account and Habibti session.
• All activity that occurs under your account.
• Providing accurate and truthful profile information. Misrepresenting your age, identity, photos, or intentions is a violation of these Terms.
• Keeping your profile information current.

You may not create multiple accounts, share your account with others, or use someone else's account. If you suspect unauthorized access to your account, contact us immediately at loveisblindhabbibi@gmail.com.

4. Prohibited Conduct

Habibti is committed to providing a safe and respectful environment. The following conduct is strictly prohibited and may result in immediate account suspension or permanent ban:

4.1 Harassment and Abuse

• Harassing, bullying, intimidating, or threatening other users.
• Using abusive, hateful, or discriminatory language.
• Stalking or repeatedly contacting a user who has indicated they are not interested.
• Making threats of violence or harm of any kind.

4.2 Inappropriate Content

• Nudity, sexual content, or sexually explicit behavior during video calls.
• Uploading inappropriate, obscene, or offensive profile photos.
• Sharing pornographic or sexually suggestive material in any form.
• Displaying illegal substances, weapons, or violent imagery during calls.

4.3 Fraud and Deception

• Using fake photos, impersonating another person, or catfishing.
• Soliciting money, gifts, or financial information from other users.
• Promoting commercial products, services, or businesses.
• Phishing, spamming, or distributing malware.

4.4 Platform Abuse

• Attempting to bypass security measures, exploit bugs, or reverse-engineer the platform.
• Using bots, scripts, or automated tools to interact with the Service.
• Interfering with or disrupting the Service or servers.
• Recording, screenshotting, or distributing video calls without the other user's consent (beyond our abuse reporting system).
• Filing false abuse reports.

5. Abuse Reporting

Habibti provides an in-call abuse reporting system. When you report another user during a video call, a screenshot may be automatically captured to support the investigation. Our trust and safety team reviews all reports and takes appropriate action, which may include warnings, temporary suspensions, or permanent bans.

By using the video call feature, you consent to the possibility that a screenshot of your call may be captured if the other participant files a report. Abuse of the reporting system (filing false or frivolous reports) is itself a violation of these Terms.

6. Subscriptions and Billing

6.1 Free Tier

New users receive 3 free video calls. Each free call has a 5-minute time limit. Once your free calls are used, a premium subscription is required to continue making calls.

6.2 Premium Subscription

The Habibti premium subscription is billed monthly through Stripe. Pricing varies by location (from $4.99/mo to $39.99/mo). Premium features include unlimited video calls with no time limit, audio-only mode, and camera toggle.

6.3 Billing and Renewal

• Subscriptions automatically renew each month unless cancelled before the renewal date.
• You will be charged on the same calendar date each month (or the last day of the month if the original date does not exist).
• All payments are processed securely through Stripe. We do not store your payment card details.

6.4 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings.
• Cancellation takes effect at the end of the current billing period. You retain premium access until then.
• We generally do not offer refunds for partial billing periods. If you believe you were charged in error, contact loveisblindhabbibi@gmail.com within 14 days of the charge.

6.5 Price Changes

We reserve the right to change subscription pricing. If we change the price, we will notify you at least 30 days before the new price takes effect. Continuing your subscription after the price change constitutes acceptance of the new price.

7. Account Freezing, Suspension, and Banning

We reserve the right to freeze, suspend, or permanently ban your account at our discretion if we determine that you have violated these Terms, pose a safety risk to other users, or are otherwise misusing the platform. Specifically:

• Warning: For minor first-time violations, we may issue a warning.
• Temporary suspension: Your account may be temporarily suspended pending investigation of a report or violation.
• Permanent ban: Severe violations (harassment, nudity, threats, fraud) may result in immediate and permanent removal from the platform.

If your account is banned for a Terms violation, you are not entitled to a refund for any remaining subscription period. You may appeal a ban by contacting loveisblindhabbibi@gmail.com.

8. Intellectual Property

The Habibti name, logo, website design, matchmaking algorithms, and all associated content are the intellectual property of Habibti and are protected by applicable copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works based on our platform without written permission.

You retain ownership of the content you upload (profile photos, profile information). By uploading content to Habibti, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for the purpose of operating and promoting the Service. This license ends when you delete your content or account, except where your content has been shared with others and they have not deleted it.

9. User Content

You are solely responsible for the content you share on Habibti, including profile photos, profile text, and anything displayed during video calls. You represent and warrant that:

• You own or have the right to share all content you upload.
• Your content does not infringe on the intellectual property or privacy rights of any third party.
• Your content complies with these Terms and all applicable laws.

We reserve the right to remove any content that violates these Terms without notice.

10. Limitation of Liability

To the maximum extent permitted by law:

• Habibti is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not guarantee that the Service will be uninterrupted, secure, or error-free.
• We are not responsible for the conduct, actions, or statements of other users, whether online or offline.
• We do not perform background checks on users and make no representations about user identity or character.
• We are not liable for any damages arising from your use of the Service, including but not limited to direct, indirect, incidental, consequential, or punitive damages.
• Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

You use Habibti at your own risk. Exercise caution and good judgment when interacting with other users, especially when meeting in person.

11. Indemnification

You agree to indemnify, defend, and hold harmless Habibti, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

12. Dispute Resolution

If you have a dispute with Habibti, we encourage you to first contact us at loveisblindhabbibi@gmail.com to attempt informal resolution. Most concerns can be resolved quickly through our support team.

If informal resolution is not successful, any dispute arising from these Terms or your use of the Service will be resolved through binding arbitration on an individual basis, except where prohibited by law. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Termination

You may terminate your account at any time by deleting it through your account settings or by contacting us. We may terminate or suspend your account at any time for any reason, including but not limited to violation of these Terms.

Upon termination:

• Your right to access and use the Service ceases immediately.
• Your profile will no longer be visible to other users.
• Active subscriptions are cancelled (no refund for the current billing period if terminated for cause).
• Data deletion follows our Privacy Policy.

Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Indemnification, and Dispute Resolution) will continue to apply.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in Delaware.

15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Habibti regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force.
• No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
• Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.
